A proposed amendment to supplement, change or generally revise the boundaries or zoning regulations may be initiated by the City Council or Planning Commission.

Property owners, the Planning Commission or the City Council may initiate a proposed amendment to a specific property. If the property is under contract, the name and mailing address of the purchaser must be on the application. All applications must be made on forms prescribed by the City and filed with the City Clerk or their designee.

The applicant must pay all costs incurred by the City, including publication costs, consultant's charges for application review, any court reporter costs, and costs of the original transcript of the hearing of the Planning Commission and copies of the same. With the payment of the filing fee, the applicant must include a cost advance with each application to be used by the City to pay for said costs. Applicants must pay the city for costs exceeding the stipulated cost advance. If costs are less than the stipulated advance, the City will refund the difference.

Zoning applications are required to send return receipt certified letters to property owners within 200 feet of the subject property.  In addition, under the City's Citizen Participation Policy, applicants also send first class mail notification to adjacent homes associations and hold a neighborhood meeting on the proposed project.  The Planning Commission public hearing is considered the official public hearing for the proposed zoning request.  The zoning request will be forwarded to the City Council after it has been reviewed by the Planning Commission.

Applicants will be scheduled for hearing no later than the second regular monthly meeting of the Planning Commission following the date of the earliest publication period available.
Notice of the hearing is published in The Johnson County Legal Record.

The factors to be considered in approving or disapproving a zoning request shall include, but not be limited to the following:

  • The character of the neighborhood;
  • The zoning and uses of property nearby;
  • The suitability of the property for the uses to which it has been restricted under its existing zoning;
  • The extent that a change will detrimentally affect neighboring property;
  • The length of time of any vacancy of the property;
  • The relative gain to public health, safety and welfare by destruction of value of the applicant's property as compared to the hardship on other individual landowners;
  • City staff recommendations; and
  • Conformance with the Comprehensive Plan.
