A Building Line Modification is a request to alter a platted setback line on an approved plat. Applicants who apply for a building line modification must include a site plan and a written statement explaining the request and addressing these three items:
- special circumstances or conditions affecting the property.
- building line modification as necessary for reasonable and acceptable development of the property in question;
- granting the building line modification will not be detrimental to the public welfare or adversely affect surrounding properties.
Applicants must be granted a variance by the Board of Zoning Appeals if they have a building line modification for a setback that is less than required by zoning regulations. The Planning Commission cannot approve these modifications.
If the building line modification is approved, the Planning Commission will adopt a resolution. The resolution will be recorded with the register of deeds before the applicant receives a building permit. The Planning Commission’s decision to approve or deny a building line modification is final. If the application for building line modification is for setback that is less than required by zoning regulations, the applicant must be granted a variance by the Board of Zoning Appeals before the Planning Commission can approve a building line modification.
The applicant must submit a digital copy of a site plan for the property to which the Building Line Modification applies and any other information that may be helpful to the Planning Commission when reviewing the application. The applicant is also required to hold a neighborhood meeting per the City’s Citizen Participation Policy.
